Thursday the Supreme Court blocked President Biden's Covid-19 vaccine or testing requirement aimed at businesses with 100 or more employees, a big win for our members. However, it allowed a vaccine mandate for certain health care workers to go into effect nationwide.
The unsigned opinion in the case states: "Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly. Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category."
The court will allow the U.S. Department of Health and Human Services' Centers for Medicare & Medicaid Services vaccine policy, originally rolled out in November 2021, to take effect. This requires the Covid-19 vaccine for certain health care workers at hospitals, nursing homes, and other facilities that participate in Medicare and Medicaid programs
